التنفيذ العيني للإلتزام في القانون المدني الجزائري

Abstract

يتمثل الأثر الجوهري للإلتزام في وجوب تنفيذه ويُقصد بذلك التنفيذ العيني، أي وفاء المدين بما إلتزم به تجاه الدائن بصورة إختيارية وهذا هو الأصل ويتم هذا التنفيذ وفقًا لشروط حددها المُشرع الجزائري في القانون المدني، وتختلف كيفية التنفيذ بحسب محل وطبيعة الإلتزام، غير أن المدين قد يمتنع أحيانًا عن التنفيذ العيني ولهذا أقر المُشرع الجزائري وسائل قانونية لإجباره على الوفاء مثل الغرامة التهديدية كما أتاح وسائل لماية تنفيذ الإلتزام كالدعوى الصورية، ويجوز للدائن أيضًا اللجوء إلى السُلطة العامة لإجبار المدين على التنفيذ وهو ما يُعرف بالتنفيذ العيني القضائي .

The essential effecte of the obligation is that it must be executed, and by this is meant the execution in kind, that is the debtor voluntarily fulfills what he has committed to the creditor, and this is the asset. This execution is carried out in accordance with the conditions set by the Algerian legislator in the civil code and the manner of execution varies depending on the place and nature of the obligation. However the debtor may sometimes refrain from execution in kind which is why the Algerian legislator has approved legal means to compel him to fulfill, suchas a threatening fine,and also provided means to protecte the execution of the obligation, such as a sham lawsuit. The creditor may also resort to the public authority to force the debtor to execute, which is known as compulsory in kind execution.
