الضبط الإقتصادي بين التكريس ومؤشرات التراجع في التشريع الجزائري

Abstract

الضبط الاقتصادي أحد الركائز الأساسية التي اعتمدتها الجزائر لضمان تنظيم السوق وحماية المنافسة ضمن سياق الانتقال نحو اقتصاد السوق. تناول البحث دراسة الإطار التشريعي والمؤسساتي للضبط الاقتصادي، مع التركيز على دور مجلس المنافسة كسلطة ضبط أفقية، إلى جانب السلطات الضبط القطاعية المتخصصة. ورغم التكريس القانوني للضبط الاقتصادي، تكشفت عدة مؤشرات للتراجع، منها تداخل الاختصاصات، ضعف التنسيق بين الهيئات، وتأخر تحديث القوانين لمواكبة التطورات الاقتصادية والرقمية. ولذا يقترح البحث مراجعة النصوص القانونية، تعزيز استقلالية الهيئات، وتنظيم آليات تنسيق فعالة، مع الاستعداد لمواجهة تحديات الاقتصاد الرقمي، بهدف بناء منظومة ضبط اقتصادي متطورة تسهم في تحقيق التنمية المستدامة وتعزيز المنافسة العادلة.

Economic regulation is one of the fundamental pillars adopted by Algeria to ensure market regulation and protect competition within the context of the transition to a market economy. This study examines the legislative and institutional framework for economic regulation, focusing on the role of the Competition Council as a horizontal regulatory authority, alongside specialized sectoral regulatory authorities. Despite the legal enshrinement of economic regulation, several indicators of decline have emerged, including overlapping jurisdictions, weak coordination between agencies, and a delay in updating laws to keep pace with economic and digital developments. Therefore, the study proposes reviewing legal texts, strengthening the independence of agencies, and establishing effective coordination mechanisms, while preparing to meet the challenges of the digital economy. This aims to build an advanced economic regulation system that contributes to achieving sustainable development and promoting fair competition.
