Abstract:
أدى التزايد الملحوظ في إبرام المعاملات الإلكترونية إلى جانب الإستخدام الواسع لشبكة الإنترنت، إلى تطور ملحوظ في أساليب وطرق إرتكاب الجريمة، وهو ما أسهم في تفشي الجرائم الواقعة على المستند الإلكتروني، ونظرًا للطابع الخاص الذي تتميز به هذه الجرائم فقد أحيطت عملية إثباتها بجملة من الصعوبات أثرت بشكل مباشر على فعالية الإثبات الجنائي، وترتبط هذه الصعوبات أولًا بطبيعة الدليل الإلكتروني الناشئ عنها، والذي يعتبر إحدى الآثار المهمة في الربط بين الجريمة ومرتكبها، كما تعود أيضًا إلى التحديات التي تواجه السلطات المكلفة بالتحري والتحقيق، وقد إستوجب هذا الوضع ضرورة تطوير الجانب التشريعي العقابي لمواجهة هذه الإنتهاكات، بما يواكب التطورالسريع الذي تعرفه الظاهرة الإجرامية، والسعي إلى إيجاد آليات جزائية مستحدثة تساير المستجدات التقنية والفنية والتكنولوجية، لاسيما مع بروز نوع جديد من التحديات أمام هذه السلطات في التصدي لهذا النوع من الجرائم وإستخلاص الدليل الإلكتروني منها. The significant increase in electronic transactions, along with the widespread use of the Internet, has led to a noticeable evolution in the methods and techniques used to commit crimes, which has contributed to the spread of offenses targeting electronic documents. Due to the particular nature of these crimes, the process of proving them has been surrounded by a number of difficulties that have directly affected the effectiveness of criminal evidence. these difficulties stem primarily from the inherent nature of the electronic evidence, resulting from such crimes, which is considered one of the key elements in establishing a link between the offense and its perpetrator. They also arise from the practical challenges faced by the authorities responsible for investigation and inquiry. This situation has necessitated the development of the punitive legislative framework to address such violations, in a manner that keeps pace with the rapid evolution of criminal phenomena and the need to establish innovative criminal mechanisms that are aligned with technological and scientiic advancements particularly in light of the emergence of new challenges facing these authorities in combating this category of crimes and in extracting relevant electronic evidence.
