Abstract

تلعب المحكمة الدستورية دورًا أساسيًا في ضمان نزاهة المسار الانتخابي في الجزائر، ما يعكس مكانتها المركزية في حماية الإرادة الشعبية وترسيخ القيم الديمقراطية، ويتجلى هذا الدور من خلال ممارستها لاختصاصات متعددة على امتداد مختلف مراحل العملية الانتخابية، ففي الانتخابات الرئاسية، تظهر صلاحياتها من خلال مرحلة الترشح، حيث تبتّ في الطعون المقدمة ضد قرارات السلطة المستقلة بشأن رفض ملفات الترشح، مما يعزز مبدأ المساواة وتكافؤ الفرص بين المترشحين. كما تمتد مهامها إلى ما بعد الاقتراع، من خلال الفصل في الطعون المرتبطة بالنتائج المؤقتة، ثم الإعلان عن النتائج النهائية للانتخابات، وهي صلاحيات تشمل أيضًا الانتخابات التشريعية والمبادرات الاستفتائية. إلى جانب ذلك، تمارس المحكمة رقابة فعّالة على تمويل الحملات الانتخابية، إذ تنظر في الطعون المتعلقة بحسابات الحملة، بما يضمن الشفافية واحترام الضوابط القانونية للتمويل الانتخابي، كما تتولى إعلان حالات الشغور داخل الهيئة التشريعية في حالات الوفاة، أو الاستقالة، أو التجريد من العهدة، وتقوم بتعيين المستخلف، ما يسهم في ضمان استمرارية المؤسسات الدستورية للدولة. The Constitutional Court plays a fundamental role in ensuring the integrity of the electoral process in Algeria, reflecting its central position in safeguarding the popular will and reinforcing democratic values. This role is evident through its exercise of various powers throughout the different stages of the electoral process. In presidential elections, its authority emerges during the candidacy stage, where it rules on appeals against decisions by the independent authority rejecting candidacy files, thereby promoting the principle of equality and equal opportunity among candidates. Its functions also extend to the post-voting phase, by adjudicating appeals related to provisional results and subsequently announcing the final election results. These powers equally apply to legislative elections and referendums. In addition, the Court exercises effective oversight over campaign financing by considering appeals related to campaign account audits, ensuring transparency and compliance with legal standards governing electoral funding. It is also responsible for declaring vacancies within the legislative body due to death, resignation, or loss of mandate, and appointing replacements, thereby contributing to the continuity of the state’s constitutional institutions.
