Abstract

يُقصد بالاعتداء على أمن الدولة كل فعل يهدد كيان الدولة وسيادتها وسلامتها واستقرار نظامها السياسي، سواء من الداخل أو الخارج وتعتبر هذه الجرائم من أخطر الجرائم في القانون الجنائي، نظرًا لما تمثّله من تهديد مباشر لأركان الدولة ومؤسساتها. وقد أفرد القانون الجزائري، في قانون العقوبات، فصولًا خاصة لتجريم هذه الأفعال، مع التنصيص على عقوبات مشددة تصل إلى السجن المؤبد أو الإعدام في الحالات الخطيرة، خاصة عندما تقترن الجريمة بالعنف أو ترتكب زمن الحرب أو تهدد الأمن القومي،كما تسعى الدولة من خلال أجهزتها الأمنية والقضائية إلى رصد هذه التهديدات والوقاية منها ومعالجتها، مع ضرورة احترام التوازن بين حماية أمن الدولة والحفاظ على الحريات العامة للمواطنين.

An attack on state security refers to any act that threatens the state's entity, sovereignty, integrity, and the stability of its political system, whether internally or externally. These crimes are considered among the most serious crimes under criminal law, given the direct threat they pose to the state's pillars and institutions. Algerian law, in its Penal Code, has dedicated special chapters to criminalizing these acts, stipulating severe penalties that may include life imprisonment or the death penalty in serious cases, particularly when the crime is accompanied by violence, is committed during wartime, or threatens national security. Through its security and judicial apparatus, the state seeks to monitor, prevent, and address these threats, while maintaining a balance between protecting state security and preserving citizens' public freedoms.
