قطع العلاقات الدبلوماسية في الفقه الإسلامي والقانون الدستوري الجزائري

Abstract

يعد موضوع قطع العلاقات الدبلوماسية من المواضيع المهمة على الصعيد الدولي والفقه الإسلامي عامة و القانون الدستوري الجزائري خاصة ، وذلك لما تعانيه اليوم الدول من توترات و صراعات في العالم في مجالات السياسة والاقتصاد ، و ذلك بسبب الخرق القواعد الدبلوماسية التي كانت محل الاتفاقيات بين الدول ،و هذا ما تم بحثه في هذه الدراسة بعنوان " قطع العلاقات الدبلوماسية في الفقه الإسلامي والقانون الدستوري الجزائري" و الهدف منها هو التعرف على المفاهيم الدبلوماسية و أسباب وضوابط قطعها لدى كل من الشريعة الإسلامية و القانون الدستوري الجزائري ، و مدى مشروعية كل منهما و الحماية المقررة لكل الفئات ، و الآثار المترتبة عند مخالفة هذه الضوابط كل ذلك تم وفق دراسة مقارنة بين كل من التشريعين. The topic of severing diplomatic relations is a significant issue on the international stage and within Islamic jurisprudence in general, and Algerian constitutional law in particular. This importance stems from the tensions and conflicts that countries face today in the fields of politics and economics, often due to violations of diplomatic rules that were subject to agreements between nations. This issue is explored in the study titled "Severing Diplomatic Relations in Islamic Jurisprudence and Algerian Constitutional Law."

The aim of the study is to understand the diplomatic concepts, reasons, and regulations for severing diplomatic relations as per both Islamic Sharia and Algerian constitutional law. It also seeks to evaluate the legitimacy of each legal framework, the protections provided for all affected parties, and the consequences of violating these regulations. All of this is analyzed through a comparative study of both legal systems.
