Abstract

"ضوابط السلطة التقديرية للقاضي الجنائي- دراسة شرعية قانونية –"، دراسة تناولت فيها السلطة المخوّلة للقاضي في تقدير الأدلّة (وسائل الإثبات) والعقوبة، على وفق ما قرَّره فقهاء الشريعة الإسلامية وشرّاح القانون، حيث قمت بتعريف السلطة التقديرية للقاضي، وبيان الأساس الشرعي والقانوني لهذه السلطة، وأهم مبدأ ارتكزت عليه وهو حرِّية الاقتناع الشخصي للقاضي الجنائي، ثمّ تطرقت لبيان هذه الأدلّة من حيث تعريفها وبيان مشروعيتها ومدى سلطة القاضي في تقدير هذه الأدلّة، ثمَّ أتيت على ذكر معنى العقوبة وخصائصها وأهم الضوابط التي ينبغي للقاضي مراعاتها والسير عليها عند تحديد العقوبة المناسبة، ضمانا لتحقيق قدر أوفى من المساواة. ”Boundaries of the discretion of the criminal judge - Legal & Legitimate perspective”: In this paper, I dealt with the power of a judge to assess evidences (means of Proof) and punishment, as determined by Islam and law scholars where Idefined the judge's discretion, and the basis of the legality and legitimacy of this power, and the most important principle upon which I focused is the freedom of the criminal judge’s personal conviction and then I came up with the statement of this evidence in terms of...definition and statement of legality and the extent to which the judge has the power to assess such evidence, and then I have come to mention the meaning and characteristics of the punishment and the most important boundaries that should be put in place in determining the appropriate penalty, the judge shall take it into account and act upon it in order to reach equality.
