ما خالف فيه قانون الأسرة المذهب المالكي

Abstract

الأسرة هي النواة واللبنة التي يقوم عليها كل مجتمع ولعل الشريعة الإسلامية الغراء قد عنت واهتمت بها في جميع تفاصيلها فقد رفعت من قيمة الأسرة وأعلت من شأنها وبنتها على دعائم قوية من القداسة والروحانية العجيبة التي يقف أمامها العقل البشري مذهولا حائرا،لذلك كانت قوانين المتعلقة بالأحوال الشخصية والأسرة تستمد من الشريعة كمصدر لها ،والجزائر على باقي الدول العربية بعد الاستقلال أصدرت قانون الأسرة سنة 1984 مصدره الشريعة الإسلامية بصفة عامة وغالبية نصوصه من المذهب المالكي السائد في الجزائر منذ قرون بصفة خاصة ثم عدل هذا القانون في سنة 2005 ،وأثار هذا التعديل جدلا واسعا في المجتمع خاصة التعديلات التي مست أركان عقد الزواج وركن الولي بصفة خاصة ، والطلاق والخلع والتنزيل في الميراث وتخالف مرجعية البلد وهو المذهب المالكي ،وعليه وسنبين في بحثنا هذافي الفصل الأول مرجعية المذهب المالكي وانتشاره في الجزائر، ومراحل تطور قانون الأسرة ومصادره، وفي الفصل الثاني المسائل التي خالف فيها قانون الأسرة الجزائري المذهب المالكي والمتعلقة بمقدمات وأركان وشروط الزواج ،وفي المسائل المتعلقة بانحلال عقد الزواج وآثاره ،وفي المسائل المتعلقة بالميراث وعقود التبرعات. The family is the nucleus and the building block on which each society is based. The Islamic Shari 'a glue has meant and cared about it in all its details. It has raised the value of the family and built it on strong pillars of holiness and wonder spirituality before which the human mind stands awestruck. personal and family status laws were therefore derived from sharia law as their source, Algeria's Family Code was promulgated in 1984 by the Islamic Shari 'a in general. Most of the provisions of the Maliki doctrine prevailing in Algeria for centuries were amended in 2005. and this amendment has given rise to a wide debate in society, especially the amendments that have affected the elements of the marriage contract and the guardian's corner in particular, Divorce, dislocation, inheritance and contravention of the country's reference, the Maliki doctrine And so we will show in our research this chapter I reference of the Maliki doctrine and its spread in Algeria, The stages of development of the Family Code and its sources, and in chapter II the issues in which the Algerian Family Code contravened the Maliki doctrine concerning the preliminaries, elements and conditions of marriage, in matters relating to dissolution and effects of marriage, inheritance and voluntary contracts
