Abstract:
تُعد آليات التهيئة والتعمير أدوات حيوية للتنظيم العمراني في التشريع الجزائري، حيث تلعب دورًا مهمًا في حماية البيئة وتطوير النسيج العمراني. تشمل هذه الآليات تشريعات وتدابير تهدف إلى تحقيق التنمية المستدامة والحفاظ على التوازن بين التطور الحضري و احترام البيئة. تعمل هذه الآليات على تحسين التخطيط العمراني، وتطوير البنية التحتية، وتوفير الإسكان والخدمات الأساسية، وتعزيز ازدهار الاقتصاد المحلي وجذب الاستثمارات. ومع ذلك، يجب التغلب على التحديات المتعلقة بتنفيذ هذه الآليات، مثل البيروقراطية ونقص التمويل. لذا، يجب تعزيز والتنسيق بين الجهات المعنية، وتعزيز المشاركة المجتمعية، وتحسين الشفافية في جميع مراحل تنفيذ المشاريع العمرانية. باستغلال الخبرات الدولية والممارسات الناجحة، يمكن للجزائر تطوير نموذج فعال للتنظيم العمراني يعكس متطلباتها ويحقق التوازن المنشود
"Tools of planning and development as mechanisms for urban regulation in Algerian legislation" explores the role of planning and development tools in urban regulation within Algerian legislation, focusing on their impact on environmental protection and urban fabric enhancement. The research highlights how these mechanisms contribute to sustainable development and maintaining a balance between urban development and environmental preservation. The study examines the legislation related to planning and development in Algeria and the available tools for urban regulation. It also addresses the vital role of these mechanisms in environmental protection, including waste management, green space preservation, and environmental sustainability. Additionally, the research explores how these tools impact urban fabric development by improving urban planning, infrastructure development, and providing housing and essential services. However, the study acknowledges the challenges associated with implementing these mechanisms in Algeria, such as bureaucracy, corruption, and funding constraints. It emphasizes the need to enhance awareness and training for professionals, improve administrative procedures, and provide adequate funding to strengthen the effectiveness of these tools. By drawing on international experiences and successful practices in planning and development, Algeria can develop an effective model for urban regulation that aligns with its requirements and achieves the balance aimed.
