Abstract:
يعتبر القصد الجنائي الصورة البارزة في الركن المعنوي للجريمة، فبدونه لا يمكن إسناد المسؤولية الجزائية لمرتكبها، ذلك أن الجاني لا يسأل عن النشاط المجرم إلا إذا ثبت وجود علاقة بين الوقائع المادية للجريمة ودرجة الاستعداد النفسي لديه ومدى خطورته الإجرامية .
وباعتبار أن القصد الجنائي أمر يضمره الجاني في نفسه ومجرد من العالم الخارجي الملموس، حيث جعل من مهمة إثباته صعبة، غير أنه متعذر إذ يمكن الاستدلال عليه من خلال وسائل الإثبات الجنائية، وكذا من خلال أثاره ومظاهره الخارجية المتعلقة بالجريمة وظروف ارتكابها، وهذا بغض النظر عن الجرائم التي جعلها المشرع الجزائري والعربي على حد سواء تقوم على افتراض العمد، حيث يعتبر القصد الجنائي (العمد) الخيط الرفيع والفاصل بين إدانة الشخص وبراءته.
The criminal intent is considered as the prominent picture in the mental elment of the crime. so ruithout it ther is no attribution of the criminal responsibility of its perpetrator. This is because the criminal doesn’t ask about the criminal activity only if there is a relation betireen the physical fact of the crime and the degree of psychological readiness and its criminal danger.
Taking into consideration that the criminal intent is an act the criminal hides and it is away from the ont side tangible world. We can do its ference througls the criminal proof means and througls its effects related to the crime withont forgetting the crims that led the Algerian legislator make its intentional assumption. So the criminal intent is the dividing line between the innocence and the condemnation
