الوساطة بين قانون الإجراءات الجزائية وقانون الطفل

Abstract

في إطار برنامج إصلاح العدالة، وضع المشرع الجزائري نصب عينيه عند إقراره تعديل قانون الإجراءات الجزائية، وفق الأمر رقم15-02، وإصداره لقانون حماية الطفل 15-12 إشراك أفراد المجتمع في إقامة العدالة من الأهداف التي يسعى لتحقيقها في إستحداثه للوساطة في المادة الجزائية، فهي تشكل مرآة عاكسة للسياسة الجنائية الحديثة والمعاصرة، من خلال جبر الضرر الناتج عن الجريمة، وتعويض المجني عليه، وكذا في إهتمامها وإعتمادها لسياسة الحد من التجريم والحد من العقاب، مع إصلاح وإدماج الجناة في المجتمع، ومحاولة لإعادة تأهيلهم اجتماعيا، كما أن فلسفة عدالة الأحداث الجانحين تقوم على أساس الإصلاح بديلا للعقوبة، وتحقيق الحماية وتكريس المصالح الفضلى لهذه الفئة.
