Abstract

تشكل ظاهرة التلوث البيئي صعودا سريعا، كقضية فرضت نفسها و أخذت مكانا متقدما على جداول الدول و الحكومات العالم، باعتبار هذه الظاهرة تشكل أكبر التحديات الراهنة للبيئة في مناهجها الاقتصادية و الاجتماعية ، و ظهور صناعات معقدة التي نتجت عنها ، آثار جد سلبية مؤثرة بشكل خطير على البيئة و هذا بالإضافة إلى أن الضرر البيئي فيها يتحقق بشكل تدريجي لا بدفعة واحدة ، كل هذه العوامل و أخرى تجعل من دراستنا تنصب على الأساس القانوني الذي يمكن للمتضرر الإسناد إليه للحصول على التعويض المناسب جزاء ما لحق به من أضرار البيئة.
