Abstract

البيع عَّلى اَّل صفة، أَّحكامو كَّنماذج مَّن تَّطبيقاتو اَّلمعاصرة يتناكؿ ىذا البحث موضوعا ىامًّا من مواضيع ابؼعاملبت ابؼالي ة، كىي مسألة البيع على الصٍّفة، تل ابؼسألة التي تعتبر قدبية في طرحها حديثة في أسلو اُّ ككسائلها ابؼعاصرة. ك ييعتٌ البحث بتأصيل ابؼسألة تأصيلب شرعيًّا، كد ا رستها د ا رسة فقهي ة مقارنة بذكر النُّصوص كال شواىد كالأدل ة، كبياف الفركع كالأقواؿ الفقهي ة فيها، لبياف ابغكم ال شرعيٍّ الذم اختلف فيو الفقهاء، كصولا إلى ال رأم ال ا رجح الذم أ ا ره يتواف مع حًكم ال شرع كمقاصده ابعليلة التي يتغي اىا في تقرير الأحكا. كما يطرؽ البحث أى م الأحكا ابؼتعلٍّقة بابؼسألة؛ من حيث الث من كابػيار كالشُّركط لتيبتٌ عليها أحكا ابؼسائل ابؼستج دة في ابؼوضوع كيت م تكييفها كًف تلكم الأحكا كال ضوابط. ث يتع رض البحث في جانبو الت طبيقيٍّ إلى بعض الن ماذج ابؼعاصرة ابؼنتشرة في ابؼيداف العمليٍّ ابؼتعلٍّقةً بالبيع على الصٍّفة؛ بغية تكييفها بدا يتواف كحكم ابؼسألة كضوابطها.Sale on product description, Its provisions and examples of its contemporary applications This research tackles an important issue of financial transactions which is the issue of sale by description. This latter is deemed old in its presentation, but modern in its contemporary style and means. This research attempts to establish a legal basis to this issue, study it from a jurisprudential standpoint by referring to texts and evidence; in order to highlight and jurisprudential sayings therein. It also aims to clarify the Sharia ruling on which the Islamic scholars differed, and propose the preponderant view that we consider is consistent with the ruling of the Sharia and its great purposes. The research deals also with the most important provisions of this issue, in terms of price, choice and conditions, in order to use them as a basis for future cases in this matter, and to adapt these future cases in accordance with those provisions and mechanisms. This research tackles, in its practical part, various contemporary models which are frequent in the field of sale by description, in order to adapt them in accordance with the rules and mechanisms of the issue.
