Abstract:
رغم الغموض الذي يشوب فكرة الأمن القانوني، إلا أنه لا يوجد جدال حول كونها فكرة جامعة تضم في طياتها العديد من المبادئ كـمبدأ الوصول للقانون، مبدأ المساواة، الشفافية وغيرها، والملاحظ في قضاء مجلس الدولة الجزائري أنه كان يحمي هذه المبادئ منذ فترة بعيدة، لكن بعد اعترافه بالأمن القانوني أضحى هذا الأخير هدفا جديدا لتلك المبادئ، الأمر الذي نجم عنه ظهور تحول في وظيفة القاضي التي أصبحت تكمن في الموازنة بين حق الأفراد في الحفاظ على أمنهم القانوني وبين احترام منطق سيادة القانون.
Malgré l'ambiguïté entourant l'idée de sécurité juridique, il ne fait aucun doute qu'il s'agit d'une idée globale qui comprend de nombreux principes, tels que le principe d'accès au droit, le principe d'égalité, de transparence, etc. On observant dans le pouvoir judiciaire du Conseil d'Etat algérien qu'il a longtemps protégé ces principes, mais après sa reconnaissance de la sécurité juridique, celle-ci est devenue une nouvelle cible de ces principes, ce qui s'est traduit par l'émergence d'un changement de fonction du juge, devenue un équilibre entre le droit des individus à maintenir leur sécurité juridique et le respect de la souveraineté de l'État de droit.
Despite the ambiguity surrounding the idea of legal certainty, there is no doubt that it is a global idea which includes many principles, such as the principle of access to the law, the principle of equality, transparency, etc. We observe in the judicial power of the Algerian Council of State that it has long protected these principles, but after its recognition of legal certainty, this has become a new target of these principles, which has resulted in the emergence of a change in the function of the judge, which has become a balance between the right of individuals to maintain their legal certainty and respect for the sovereignty of the rule of law.
