الترجيح بالمقاصد في فتاوى النوازل ( التأصيل و التفعيل)

Abstract

يتناول هذا البحث موضوع فتاوى النوازل التي باتت تؤرق العقل الفقهي و تشغل بال الفكر الأصولي و تؤزه نحو بعث نهضة تأصيلية تنظيرية جديدة تتخذ من مقاصد الشريعة أداة اجتهادية تتوائم و زخم المستجدات و الحوادث اللامتناهية في زمن الثورة الرقمية و التقنية و انتشار الأوبئة ، فيأتي هذا البحث بمباحثه الأربع للإبانة عن دور الترجيح بمقاصد الشريعة الإسلامية في التصدي لهذه المستجدات بحلول شرعية مناسبة ، في ظل تعدد الآراء الفقهية و الرؤى الاستدلالية، و ينظر البحث في مدى صلاحية مقاصد الشريعة لأن تكون ميزانا توزن به النوازل ويحتكم إليها حال الخلاف و التّعارض. و تطرق البحث للعدّة الإجرائية التي لابد منها للمفتي المتصدي للنوازل في غضون تفعيله للترجيح بالمقاصد، حتى تتسم فتواه بالتّوازن و الاعتدال و عدم التّناقض و الاضطراب ، من ضوابط و قواعد و أسس و مقومات ، هذا وقد اتخذ البحث من نازلة وباء كورونا المستجد محلا ميدانا لتجلية كل ذلك والتمثيل و التطبيق، ، من خلال تقصي مسلك الترجيح بالمقاصد في الفتاوى التي صدرت بشأنه، ليتجلى بوضوح قوة حضور المعاني المصلحية و الابعاد المقاصدية في أغلبها.This research deals with the subject of the fatwas of calamities, which have become disturbing the jurisprudential mind and preoccupy the mind of fundamentalist thought and lead it towards the revival of a new fundamentalist theorizing renaissance that takes from the purposes of Sharia a jurisprudential tool that is compatible with the momentum of developments and endless accidents in the time of the digital revolution and technology and the spread of epidemics, so this research comes In its four chapters of showing the role of weighting the purposes of Islamic law in addressing these developments with appropriate legal solutions, in light of the multiplicity of jurisprudential opinions and inferential visions, the research looks at the validity of the purposes of Sharia to be a scale by which calamities are weighed and invoked in the event of disagreement and conflict. The research touched on the procedural equipment that the mufti should arm himself with while activating the weighting of the objectives, so that his fatwa is characterized by balance, moderation, non-contradiction and turbulence, from controls, rules, foundations and components. To clarify all of this, representation and application, by examining the way of weighing the intentions in the fatwas issued on it, so that the strength of the presence of interest meanings and the intentional dimensions in most of them becomes clear.
