أحكام العرف في العلاقات الدولية ــدراسة مقارنة بين الفقه الإسلامي و القانون الدولي ــ

Abstract

العام والقان ون الدولي الخاص, ويعبر عن ذلك التطبيقات العديدة للعرف الدولي في القانون الدولي, حيث نجده يحتل مكانة هامة في تأسيس معظم المعاهدات والمواثيق الدولية المختلفة لما يمتاز به من قواعد عرفية عامة وشاملة, تلقى إجماعا دوليا ورواجا . في الجانب الآخر يظهر جليا اهتمام الشريعة الاسلامية بالعرف الدولي من خلال الأحلاف والمعاهدات التي عقدها النبي صلى الله عليه وسلم مع غيره المسلمين بناء على أعراف دولية قبلية, وكذلك الالتزام بعدم قتل الرسل, كمبدأ عرفي يسري أثره بين مختلف البلدان, ويحتل العرف الدولي مكانة هامة كمصدر تبعي للتش ريع الاسلامي في حال عدم وجود نص شرعي .International custom is considered the fundamental and oldest source in the legislation of international law. We mean here specifically public international law and private international law. This is reflected in many applications of international custom in international law. Where we find it occupies an important place in the establishment of most of various international treaties and charters due to its general and comprehensive customary rules. It finds an international consensus and popularity. On the other hand, the Islamic Sharia’s interest in international custom is evident through the pacts and treaties that the Prophet, may God’s prayers and peace be upon him, made with non-Muslims based on international tribal norms, as well as the obligation not to kill the messengers, as a customary principle that has its effect among different countries. furthermore, the international custom occupies an important position as a subsidiary source of Islamic legislation in the absence of a legal text.
