This is a study of some of the jurisprudence rules related to financial transactions;
This was done through the comprehensive interpretation of the provisions of the Qur’an
by Imam al-Qurtubi، which included a brief translation of the sheikh and a definition of
his interpretation and jurisprudence rules، and then a study of nine jurisprudential rules
related to financial transactions in the following order:
Common rules between exchanges and donations، the rule of “original holding
contracts to be valid،” the rule of “origin in infallible funds،” and the rule of “origin in
contracts is mutual consent.”
Rules governing compensation: “The rule of “negotiation contracts are not valid
with ignorance”، the rule of “the principle in contracts is necessary”، and the rule
“ignorance of symmetry is like knowledge of details”.
There are rules governing donations، the rule “forgivable in donations what is not
forgivable in exchanges”، the rule “the donation is only made by taking possession”، and
the rule “every offer may be sold may be mortgaged”.
I dealt with the study of these rules to explain the rule and clarify its meaning، then to the
authority of the rule according to Imam Al-Qurtubi، then to the evidence for the rule، and
finally to some of its applications in jurisprudential issues.
