دور البلدية في مجال حماية البيئة في اطار التنمية المستدامة

Abstract

ملخص الأطروحة: تنفيذا للسياسة البيئية في الجزائر وفق إطار التنمية المستدامة على المستوى المحلي، تتمتع البلدية تشريعيا بمجموعة من الصلاحيات أوكلت إلى هيئاتها في العديد من المجالات المرتبطة بالبيئة، مثل حماية الصحة العمومية والصحة الحيوانية والصحة النباتية و حماية الموارد الطبيعية و حماية جميع الأوساط البيئية ومحاربة التلوث بأنواعه، سواء أكان مصدره الإنسان مثل إفراز النفايات بجميع أصنافها وحرائق الغابات أو مصدره الطبيعة مثل الكوارث الطبيعية مثل الفيضانات والزلازل والجفاف وغيرها. و في مواجهة تلك المشاكل تعتمد البلدية على تبني مبادئ حماية البيئة والتنمية المستدامة لاسيما منها مبدأ المشاركة و مبدأ الإدماج و مبدأ الملوث الدافع وغيرها من المبادئ إلى جانب أدوات التخطيط البيئي و تطبيقها بواسطة وسائل الضبط الإداري. الكلمات المفتاحية: الجماعات الاقليمية، البلدية، البيئة، التنمية المستدامة، الضبط الاداري، التخطيط Abstract: In implementation of the environmental policy in Algeria in accordance with the framework of sustainable development at the local level, the municipality enjoys legislatively a set of powers entrusted to its bodies in many areas related to the environment, such as the protection of public health, animal health, plant health, the protection of natural resources, the protection of all environmental circles and the fight against pollution of all kinds, Whether its source is human, such as the secretion of waste of all kinds and forest fires, or its source is nature such as natural disasters such as floods, earthquakes, drought and others. In the face of these problems, the municipality depends on adopting the principles of environmental protection and sustainable development, especially the principle of participation, the principle of inclusion, the principle of pollutant motive and other principles, in addition to environmental planning tools and their application by means of administrative control. Key words: territorial collectivités, municipality, environment, sustainable development, administrative control, planning Résumé: Dans la mise en œuvre de la politique environnementale en Algérie conformément au cadre de développement durable au niveau local, la commune bénéficie législativement d'un ensemble de compétences confiées à ses organes dans de nombreux domaines liés à l'environnement, tels que la protection de la santé publique, la santé, la santé des végétaux, la protection des ressources naturelles, la protection de tous les milieux environnementaux et la lutte contre les pollutions de toutes sortes, Que sa source soit humaine, comme la sécrétion de déchets de toutes sortes et les incendies de forêt, ou sa source soit la nature comme les catastrophes naturelles telles que les inondations, les tremblements de terre, la sécheresse et autres.. Face à ces problèmes, la municipalité dépend de l'adoption des principes de protection de l'environnement et de développement durable, notamment le principe de participation, le principe d'inclusion, le principe du pollueur payant et autres, en plus des outils de planification environnementale et leur application par moyens de contrôle administratif.
