In this thesis, I have studied the rule of resorting to artificial insemination to
avoid genetic diseases. In the first chapter, I dealt with a statement of the concept
of artificial insemination (Its origin, reality, techniques...), and its most important
Islamic jurisprudence rules. As for the second chapter: I have explained the
concept of genetic diseases. (its truth, types,...), and the role of artificial
insemination in avoiding this type of diseases (models of genetic diseases that can
be avoided through artificial insemination, its methods and techniques, its benefits
and disadvantages)
In the third chapter: I have explained the view of Islamic law on genetic
diseases and I have studied the rule of resorting to artificial insemination to avoid
genetic diseases. The fourth chapter: Was devoted to studying the most important
Islamic jurisprudential effects related to this medical discovery.
In this thesis, I have reached many results, the most important of which are:
The permissibility of artificial insemination to bypass the obstacle of infertility,
and to avoid dangerous genetic diseases - taking into account the conditions and
controls-, As it seems to me; It is forbidden to deliberately obtain surplus fertilized
ovum, especially in the presence of the technique of freezing ovums before
fertilization, but if Allah decrees their existence, It proves them a sanctity that
befits them, they should be taken into account and not wasted, And it is
permissible to freeze them in the event that the need for them remains urgent, And
it is permissible to use them in laboratory experiments, and scientific research, -
with due regard to the conditions-, But in the case of dispensing with it, it is not
permissible to destroy it, but rather let it die to the death of its nose. As for gene
therapy; It is permissible to resort it to treat diseases that affect the somatic cells,
and on the other hand, it is forbidden to treat the reproductive cells, except in the
case that it is the last solution to avoid the obstacle of sterility. As for the ruling on
genetic improvement, it is permissible to return the deformed organ to its original
creation, and it is prohibited if the purpose is to change some formal or intangible
characteristics.
Finally, I have concluded my thesis by mentioning the most important results
that I reached and the recommendations that I have suggested. |
