العرف ودوره في تحقيق الأمن الفكري والاجتماعي

Abstract

في هذه الورقة البحثية سوف أتعرض لمفهوم العرف لغة واصطلاحا، وبيان الألفاظ ذات الصلة كالعادة، ثم أتحدث عن أهميته في الشريعة الإسلامية كمصدر من مصادر التشريع بحيث يرجع إليه المجتهد والمفتي والقاض ي ورجال الإصلاح، ثم أتحدث عن أنواع العرف من حيث باعتبار العموم والخصوص باعتبار سببه ومتعلقه، وباعتبار صحته وفساده، ثم أتحدث عن حجيته واختلاف العلماء فيه، ثم أتحدث عن ضوابطه شروط اعتباره In this research paper, I will address the concept of custom in terms of language and terminology, and explain the related terms as usual. I will then discuss its importance in Islamic law as a source of legislation, to which the mujtahid, the mufti, the judge, and reformers may refer. I will then discuss the types of custom in terms of generality and specificity, its cause and its relation, and its validity and invalidity. I will then discuss its authority and the differences of opinion among scholars regarding it. I will then discuss its controls and conditions for its validity.
