شروط جهاد الدفع وضوابطه دراسة فقهية

Abstract

تناولت في بحثي مسألة مهمة من المسائل الفقهية ألا وهي الجهاد الذي له مكانة رفيعة في الإسلام حيث يعتبر ذروة سنامه وأفردت النظر في فرع من فروعه ألا وهو جهاد الدفع من حيث الشروط والضوابط؛ وبعد التحري والتدقيق في أقوال الفقهاء وجدت أن أغلبهم لا يوجبون أي شرط من شروط الجهاد أما ضوابطه فهي في عمومها لا تختلف عن ضوابط الجهاد في الإسلام هذا بخصوص عنوان البحث أما باقي المحاور فقد تطرقت لتعريف الجهاد والألفاظ ذات الصلة به حتى نميز بين المصطلحات المختلفة ولا يختلط الحابل بالنابل، ثم بعد ذلك عرجت على النصوص الواردة في الموضوع حتى يكون لكلامي معنى، ولبيان أكثر كان علي أن أذكر بعضا من جوانب الجهاد في ديننا الحنيف فتطرقت إلى أنواعه، وحكمه، وفضله، وأهميته، وبعد هذا انتقلت للرد على شبهات أثيرت حول الجهاد لتبقى صورته صافية نقية ودحضتها بالأدلة القاطعة التي لا ينكرها إلا جاحد، وختمت بحثي بذكر نماذج واقعية لجهاد الدفع من خلال تاريخ أمتنا المجيد منذ عصر الرسالة إلى يومنا هذا وما يستفاد منها من دروس وعبر. In my research, I addressed an important issue of the jurisprudential issues, which is Jihad which has a high status in Islam, as it is considered the pinnacle of its hump. I devoted attention to one of its branches, which is defensive jihad, in terms of conditions and controls. After investigating and examining the statements of the jurists, I found that most of them do not require any condition of Jihad. As for its controls, they are generally no different from the controls of jihad in Islam. This is regarding the title of the research. As for the rest of the topics, I touched on the definition of jihad and the terms related to it so that we can distinguish between the different terms and not get confused. Then after that, I touched on the texts mentioned in the topic so that my words would have meant to clarify more, I had to mention some aspects of jihad in our true religion, so I touched on its types, its ruling, its merits and its importance. After this, I moved on to respond to the doubts that were raised about jihad so that its image would remain pure and clean, and I refuted then with conclusive evidence which no one denies except a denier, and I concluded my research by mentioning realistic examples of defensive jihad through the glorious history of our nation from the era if the message to this day and the lessons and morals than can be learned from them.
