Abstract

تناولت دراستنا مفهوم مصرف في سبيل الله وتطبيقاته المعاصرة، ولأن دلالة " في سبيل الله" مبهمة، وحصرها في الغزو والقتال من شأنه تعطيل بعض المصالح العامة للأمة، انطلقنا من أهمية الزكاة وأنها مورد أساسي لتلبية حاجة الأمة للمال، وعرجت باختصار على ذكر جميع مصارف الزكاة الثمانية، وأنها تستغرق جميع لحاجات للأمة، ثم حددت مفهوم "وفي سبيل الله"، وبينت دلالة العموم فيه وتحليلها، ومناقشة المذاهب؛ وبحثت عن حكمة الشارع من ذكره مجملاً دون باقي المصارف، واعتمدت على دلالة القرآن، وما صح من السنة، وأقوال الصحابة والتابعين، وما رَجَحَ من أقوال الفقهاء والمفسرين. واتبعت في البحث المنهج الوصفي التحليلي، ولم ألتزم مذهبا معينا، وإنما أسوق الأقوال والأدلة لكل مذهب، وأحرر المسائل، وأناقشها، وأرجح ما كان أقوى في دليله وحجته، وأقرب للمصلحة العامة للأمة، وبما يحقق مقاصد الشريعة السمحة. فكانت ثمرة الدراسة؛ أن مصرف "وفي سبيل الله" يشمل وجوه البر وسبل الخير، دون قصره على الغزو في سبيل الله؛ لأن سبيل الله عام في الكل، فلا يختص بصنف دون غيره، وقصره على الغزو يحتاج إلى دليل ولا دليل من نص أو إجماع صريح. والله أعلم. Our study dealt with the concept of Charity for the sake of God and its contemporary applications. Because the meaning of “for the sake of God” is ambiguous, and limiting it to invasion and fighting would disrupt some of the general interests of the nation, we started from the importance of zakat and that it is an essential resource to meet the nation’s need for money, and I briefly mentioned all the disbursements of zakat. The eight, and that they take up all the needs of the nation, then defined the concept of “and for the sake of God,” and clarified the general significance of it, analyzed it, and discussed the doctrines; I searched for the wisdom of the Law in mentioning it in general, without the rest of the meanings, and relied on the meaning of the Qur’an, what is authentic from the Sunnah, the sayings of the Companions and Followers, and the most likely sayings of the jurists and commentators. In the research, I followed the descriptive and analytical method, and did not adhere to a specific school of thought. Rather, I presented the statements and evidence for each school of thought, edited the issues, discussed them, and preferred what was strongest in its evidence and argument, closest to the general interest of the nation, and in a way that achieves the purposes of tolerant Sharia. It was the result of our study; The phrase “ for the sake of God” includes all aspects of righteousness and paths of goodness, without limiting it to fighting for the sake of God. Because God’s path is general to all, it is not specific to one group or another, and limiting it to conquest requires evidence, and there is no evidence from a clear text or consensus. God knows.
