أوقاف منطقة متليلي: حصر وتقييم في ضوء الفقه الإسلامي والقانون الجزائري

Abstract

تهدف هذه المذكرة إلى دراسة واقع الأوقاف في منطقة متليلي بولاية غرداية، من خلال حصرها وتقيميها في ضوء أحكام الفقه الإسلامي والتشريعات القانونية الجزائرية. وقد انطلقت الدراسة من فرضية أن للوقف دورا أساسيا في دعم التنمية الشاملة، بشرط حسن توجيهه وتفعيله. وأوقاف منطقة متليلي عقارية ومنقولة، وأبرز الأوقاف العقارية المساجد، وأهمها المسجد العتيق الذي أدى دوره الثوري وهو يواصل مهامه العلمية والاجتماعية. إضافة على أوقاف الطرق والآبار التي توفر تسهيلات كبيرة للسكان. كما أن الأوقاف المنقولة، التي تشمل وسائل تعليمية وطبية واجتماعية، لها دور فعال في خدمة مختلف شرائح المجتمع. وبتقييم أوقاف منطقة متليلي تظهر بوضوح آثارها الإيجابية إيمانيا وتعليميا واقتصادية، دون أن تخلو من بعض المعوقات مثل: غياب التوثيق القانوني، إهمال بعض الأوقاف وضعف صيانتها. وقد خلُصت الدراسة إلى ضرورة تحديث نظام إدارة الأوقاف بالمنطقة، وتحفيز المجتمع المحلي على الانخراط في المشاريع الوقفية، مع تعزيز التعاون بين الجهات الرسمية والمجتمع المدني. This research aims to study the reality of endowments in the Metlili region of Ghardaia province, by inventorying and evaluating them in light of the provisions of Islamic jurisprudence and Algerian legal legislation. The study was based on the hypothesis that endowments play a fundamental role in supporting comprehensive development, provided they are properly directed and activated. Endowments in the Metlili region are real estate and movable, the most prominent of which are mosques, the most important of which is the old mosque, which has played its revolutionary role and continues to perform its scientific and social duties. In addition, endowments for roads and wells provide significant facilities for the population. Furthermore, movable endowments, which include educational, medical and social facilities, play an effective role in serving various segments of society. An evaluation of the endowments of the Metlili region clearly reveals their positive impacts on faith, education and the economy, although they are not without some obstacles such as: the absence of legal documentation, neglect of some endowments and poor maintenance. The study concluded that it is necessary to update the endowment management system in the region, encourage the local community to engage in endowment projects, and enhance cooperation between official bodies and civil society.
