حماية الطفل أثناء النزاعات المسلحة غير الدولية

Abstract

مع انتشار النزاعات المسلحة غير الدولية في الكثير من أقاليم الدول ولاسيما في العقود الأخيرة وما تتصف به من عنف وضرر على الحياة الاقتصادية والاجتماعية، وما تخلفه من آثار شاملة على السكان المدنيين بكل فئاتهم نساء ورجالا وأطفالا، وباعتبار أن الأطفال هم أكثر فئات المجتمع ضعفا وهشاشة واستهدافا لكونهم لا يملكون القدرة الجسمية والنفسية الكافية للمواجهة وحماية انفسهم، وبالتالي أخذ القانون الدولي على عاتقه التكفل بحمايتهم من خلال التشريع النصي وما جاء به من المواثيق والاتفاقيات الدولية والإقليمية في ظل القانون الدولي لحقوق الإنسان والقانون الدولي الإنساني، ويتطلب تجسيد تلك المواثيق اليات دولية مؤسساتية ذات طابع إنساني وقضائي وبإشراف هيئة الأمم بكل أجهزتها الرئيسية والفرعية، من اجل ضمان حماية فعالة للأطفال أثناء النزاعات المسلحة غير الدولية.

Considérant que les conflits armés non internationaux se propagent dans de nombreuses régions du pays, en particulier au cours des dernières décennies, se caractérisent par la violence et la destruction de la vie économique et sociale, ainsi que par leurs effets complets sur toutes les catégories de femmes, d'hommes et d'enfants civils, et considérant que les enfants constituent le groupe le plus vulnérable, le plus vulnérable et le plus ciblé de la société, car ils ne sont pas suffisamment capables physiquement et mentalement de se confronter et de se protéger, et que, par conséquent, le droit international assume la responsabilité d'assurer leur protection, conformément au droit international des droits de l'homme et au droit international humanitaire, au moyen de textes législatifs et de chartes et conventions internationales et régionales, La concrétisation de ces chartes exige la mise en place de mécanismes institutionnels internationaux à caractère humanitaire et judiciaire, sous la supervision des institutions internationales et de tous leurs organes principaux et subsidiaires, afin d'assurer une protection efficace des enfants en période de conflit armé non international.
