Abstract

يعد اختطاف الأشخاص من الجرائم الخطيرة التي تمس أمن المجتمع واستقراره، لما لها من آثار نفسية وجسدية عميقة على الضحية والمجتمع على حد سواء، حيث تتمثل هذه الجريمة في قيام الجاني بأخذ شخص أو احتجازه أو نقله قسرًا دون إرادته، باستخدام القوة أو التهديد أو الحيلة أو أي وسيلة أخرىبهدف تحقيق المنفعة الشخصية، وتختلف دوافعها باختلاف الظروف والجناة، فقد يكون بدافع الانتقام أو الحصول على المال أو لأغراض إجرامية أخرى كالإتجار بالبشر أو الاستغلال الجنسي، حيث برزت الحاجة الماسة إلى وضع أطر قانونية فعالة للوقاية من هذه الجرائم ومكافحتها، وهو ما استجابت له المشرع الجزائري من خلال القانون رقم 20-15 المتعلق بالوقاية من جرائم اختطاف الأشخاص ومكافحتها، حيثشدد التشريع الجزائري العقوبات المقررة على هذه الجريمة.

Kidnapping is considered one of the most serious crimes that threaten the security and stability of society, due to its profound psychological and physical impact on both the victim and the community, This crime involves the perpetrator forcibly taking, detaining, or transporting a person against their will through the use of force, threats, deception, or other means, with the aim of achieving personal gain, The motives behind kidnapping vary depending on the circumstances and the perpetrators—it may stem from revenge, financial gain, or other criminal purposes such as human trafficking or sexual exploitation, This pressing danger has highlighted the need for effective legal frameworks to prevent and combat such crimes, In response, the Algerian legislator enacted Law No. 20-15 on the prevention and fight against kidnapping, which imposes stricter penalties on this crime.
