بيع الوفاء وتطبيقاته المعاصرة

Abstract

هذا البحث يــهدف من خلال عنوانه إلى بيان بيع الوفاء وما يعتريه من أحكام فقهية، ناقلا أقوال العلماء والفقهاء فيه، ومحاولا إبراز أدلة كل فريق ومناقشتها، ثمّ الترجيح إن أمكن، ثم إسقاط هاته الأحكام على جوهر الشريعة ولبّها ألا وهي المقاصد، وذلك للتوصل إلى فروقات ونتائج بناء على هاته الإسقاطات المقاصدية. وهذا الشّـــــــــق النظري أردفته بشقّ تطبيقي معاصر، يوضّح أهم التطبيقات العصرية لهذا البيع، وتوضيحها مبرزا أوجه الشبه وعلاقتها ببيع الوفاء. وكما هو الشأن مع المواضيع الفقهية فقد اعتمدت في الطّــــرح الموضوعي على المنهج الوصفي والاستقرائي والمقارن، فالأول لتبيين التعاريف والأحكام، والثاني لجمع المادة العلمية والفقهية من مختلف المصادر، والأخير للمقارنة بين الأقوال والترجيح بينها إن وُجد. وقد توصلت من خلال هاته الدراسة إلى بعض النتائج المهمّة، أوردتها في خاتمة البحث . This research aims at indicating the sale of fulfilment and its jurisprudence, conveying the words of scholars and jurists, trying to produce and discuss the evidence of each team, then weighing if possible, and dropping those judgments on the essence of the Shari 'a and its core, namely the purposes, in order to reach differences and results based on these intended projections.

This theoretical faction, coupled with a contemporary application, illustrates the most modern applications of this sale, highlighting similarities and their relationship to the sale of fulfilment. As with doctrinal subjects, in the substantive presentation it relied on a descriptive, extrapolatory and comparative approach, the first to define definitions and provisions, the second to collect scientific and doctrinal ( jurisprudence ) material from various sources, and the last to compare and weigh statements, if any. Through this study, I found some important findings, which I quoted at the conclusion of the research.
