تطهير حساب العقارات غير المطالب بها الناجمة عن مسح الأراضي

Abstract

المسح العقاري هو تلك العملية الفنية والقانونية التي ترمي الى تحديد هوية العقارعن طريق تثبيت موقعه ، وتعريفالملاك التي تترتب لهم أو عليهم تلك الحقوق العينية حتى يتم تأسيس سجل عقاري، ولابد من مراحل أساسية من أجل تثبيت الملكية العقارية، فبعدم قدرة عون المسح على تحديد المالك أو الحائز للعقار يتم تسجيلها في حساب العقارات الغير مطالب بها، هو إشكال من الاشكالات واجهت عملية المسح،ولقد حاولت المديرية العامة للأملاك الوطنية التصدي بإصدار تعليمات خاصة،إلا أنها لم تجد نفعا. ثمجاء قانون المالية لسنة 2015 بالمادة 67 منه، غير أن الادارة أغفلت التعامل مع الاشكال فسجلت الاملاك غير مطالب بها تلقائيا باسم الدولة بصورة ألية.حتى صدور قانون المالية لسنة 2018 بموجب المادة 89 منه التي وضعت آلية جديدة للتسوية القانونية والإدارية لوضعية هذه العقارات. Then the Finance Law for the year 2015 with Article 67 thereof, but the administration neglected to deal with the problems, so the unclaimed properties were registered automatically in the name of the state in an automatic manner. Until the issuance of the Finance Law for the year 2018 according to Article 89 thereof, which established a new mechanism for the legal and administrative settlement of the status of these properties. .
