إثبات الأملاك الوقفية في التشريع الجزائري

Abstract

يعتبر نظام الوقف نظاما فريداً متميزاً من غيره من الأنظمة المختلفة سواءاً الاقتصادية أو التجارية أو الاجتماعية لكونه قد احتوى جميع هذه الأنواع، فهو نظام يساهم في تنمية المجتمع في كل المجالات لذلك أولاه المشرع الجزائري عناية خاصة تجلت في مجموعة النصوص القانونية الخاصة به، والأساس فيها هو قانون الأوقاف رقم 91/10 وتعتبر مسألة إثبات الأملاك الوقفية مسألة جوهرية في هذه النظم، فعلى أساس هذه الأملاك يقوم نظام الوقف، لذلك اهتم المشرع بتنظيم وسائل إثبات الأملاك الوقفية نظرا لارتباط الأملاك الوقفية بمسألة جوهرية هي وجود نظام الوقف وضمان تحقق مقاصده وديمومته، فقد أجاز المشرع إثباتها بكل الطرق القانونية والشرعية. Therefore, the legislator was interested in regulating the means of proving endowment property due to the link between endowment property and a fundamental issue, which is the existence of the endowment system and ensuring the achievement of its purposes and its permanence. The legislator proves it by all legal and legitimate means.
