جريمة الإهمال العائلي في التشريع الجزائري

Abstract

تناولت الدراسة جريمة الإهمال العائلي في التشريع الجزائي الجزائري، بهدف ردع أي مساس بأمنها واستقرارها، والتأكيد على احترام حقوق أفرادها. قام المشرع بإيلاء اهتمام خاص لهذه القضية من خلال تجريم ترك الأسرة واعتباره جريمة. تعرف هذه الجريمة بإهمال الوالدين، وتم تخصيص فصل خاص لها في الباب الخامس من الفصل الثاني الجزء الثاني من قانون العقوبات، تحت عنوان "ترك الأسرة".تتضمن الجريمة أربعة أشكال محددة، وهي المدرجة في المادتين 330 و331 من قانون العقوبات الجزائري. تشمل هذه الأشكال ترك مقر الأسرة، وترك الزوجة الحامل، وإهمال الأطفال أخلاقيًا، والامتناع عن دفع النفقة المخططة.تركزت الدراسة على تحليل الأحكام الموضوعية والإجرائية المتعلقة برصد ومراقبة حالات إهمال الأسرة، وذلك بهدف فهم وتحليل هذه الصور الجرمية المنصوص عليها في المواد المذكورة أعلاه The study addressed the crime of family negligence in Algerian criminal legislation, with the aim of deterring any infringement on its security and stability, and emphasizing the respect for the rights of its members. The legislator has given special attention to this issue by criminalizing family abandonment as a crime. This crime, known as parental negligence, has been allocated a specific section in Chapter Five of Part Two of the Penal Code, titled "Family Abandonment." The crime encompasses four specific forms, as stated in Articles 330 and 331 of the Algerian Penal Code. These forms include abandoning the family home, abandoning a pregnant wife, moral neglect of children, and refusing to pay the planned expenses. The study focused on analyzing the objective and procedural provisions related to detecting and monitoring cases of family negligence, with the aim of understanding and analyzing these criminal patterns as outlined in the aforementioned articles.
