منظومة الوصاية وتأثيرها على إستقلالية الجماعات المحلية في التشريع الجزائري

Abstract

تتمتع الجماعات المحلية بالاستقلالية، وهذا نتيجة للاعتراف لها بالشخصية المعنوية من قبل المشرع الجزائري، إذ تمس هذه الاستقلالية جميع جوانب الهيئات ومنها الجانب العضوي والجانب المالي وكذا الموضوعي، وذلك من أجل القيام بوظائفها بكل حرية والتكفل بالإدارة وتسييرالشؤون المحلية من خلال تلبية متطلبات ورغبات المواطنين في سبيل تحقيق التنمية المحلية، فاستقلال الجماعات المحلية يعتبرالمعيارالحقيقي الذي بواسطته تستطيع هذه الجماعات النهوض بأعباء التنمية المحلية. ورغم تمتع الجماعات المحلية بالاستقلالية إلا ان المشرع أخضعه الرقابة السلطات الوصية وهي ماتعرف بالوصاية الادارية وهذامن أجل الحفاظ على وحدة الدولة وأمنها لان الاستقلال المطلق للجماعات المحلية يؤدي الى خلق دولة داخل دولة هذا من جهة، ومن جهة أخرى مراقبة مدى مشروعية اعمال هذه الهيئات من خلال تطابقها لمبدأ المشروعية.
