Abstract

سعيا منها لتحقيق وضمان تنمية إقليمية مستدامة ومتوازنة على مستوى كل القطاعات خاصة التنمية الاقتصادية، ونظرا لأهمية الاستثمار كونه آلية فعالة في العملية الاقتصادية، فإن الجزائر عمدت ومنذ استقلالها للاهتمام به، ولأنّ التشريعات الاستثمارية أداة الدولة لتشجيع الاستثمار من خلال الضمانات والحوافز التي تساهم في تهيئة مناخ استثماري ملائم يستقطب المستثمرين. ونظرا للتطورات الاقتصادية العالمية كان لزاما على الجزائر تكييف منظومتها القانونية بما يتماشى مع هذه المعطيات، حيث عرفت المنظومة التشريعية الجزائرية إصدار العديد من قوانين الاستثمار، آخرها قانون الاستثمار 22-18، والذي حاول المشرع من خلاله كسب ثقة المستثمرين، وفتح آفاق جديدة للاستثمار، حيث جاء فيه العديد من الضمانات القانونية إضافة إلى استحداث آليات جديدة تساهم في توفير بيئة استثمارية ملائمة.
