Abstract

تناولت هذه الدراسة موضوع الوكالة في الأحوال الشخصية _نموذجا _ الطلاق _ دراسة مقارنة بين الشريعة والقانون، فبعد الكشف عن تعريفات البحث التي تكمل في الوكالة والأحوال الشخصية والطلاق ومقارنتها بين الشريعة والقانون، وتعرفنا على ألفاظ ذات الصلة بالوكالة والوكالة في الطلاق وتطرقنا لنشأة مصطلح الأحوال الشخصية للتعرف أكثر وفهم مصدره، ومن ثم رأينا مشروعية الوكالة والطلاق وأنواعهما للتعمق وفهم الموضوع أكثر للقارئ، وبعدها تطرقنا إلى صلب الموضوع الوكالة في الطلاق مقارنة داخلية بين الشريعة والقانون، ورأينا آراء العلماء من مشروعيتها في الجانب الفقهي والقانوني، والألفاظ التي تتم بها الوكالة في الطلاق وكيف تتم الوكالة في الطلاق، ومن ثم تناولت أنواع الوكالة، ورأينا مسألة توكيل المرأة والصبي والذمي بالطلاق ،وتعرفنا عن وكالة الأجنبي كيف تكون ألفاظها إما صريحة أو كناية، وتعرفنا كيف تكون نهاية الوكالة في الطلاق وكيف يتم الرجوع عنها، و رأينا أن جانب الشريعة هو الأوضح من ناحية الدلائل و المشروعية والأشمل لرؤية موضوعنا بنظرة مفهومة ومعمقة أكثر و كيف أعطاه مكانة . This study dealt with the subject of agency in personal status _ model _ divorce _ a comparative study between Sharia and law, after revealing the definitions of research that complement in agency, personal status and divorce and comparing them between Sharia and law, and we got acquainted with terms related to agency and agency in divorce, and we touched on the emergence of the term personal status To get to know more and understand its source, and then we saw the legality of agency and divorce and their types to deepen and understand the topic more for the reader, and then we touched on the core of the issue of agency in divorce, an internal comparison between Sharia and law, and we saw the opinions of scholars on its legitimacy in the jurisprudential and legal aspect, and the words in which agency is carried out in divorce and how Agency is completed in divorce, and then I dealt with the types of agency, and we saw the issue of empowering a woman, boy and dhimmi to divorce, and we learned about the agency of a foreigner, how its words are either explicit or figurative, and we learned how the end of agency ends in divorce and how it is revoked, and we saw that the aspect of Sharia is the clearest In terms of evidence, legitimacy and comprehensiveness to see our subject with a more in-depth and understandable view, and how it gave it a place.
