تطبيقات الذكاء الاصطناعي في نشاط الإدارة العامة

Abstract

تهدف هاته الدراسة لبحث اثر تطبيق ممكنات الذكاء الاصطناعي في نشاط الإدارة العامة ومدى توظيفها بدخول الإدارة العامة إلى عصر الإدارة الالكترونية بعد التحول من النمط التقليدي ووصولا إلى النمط الذكي وذلك بالسماح بإيجاد تطبيقات للذكاء الاصطناعي في العديد من النشاطات مع دراسة وتحديد وضبط القوانين والتشريعات دون الخوض في الجانب التقني منه ولقد تم دراسة النظام القانوني والمسؤولية القانونية الناتجة عن هذا التطبيق وتناولت الدراسة تطبيقات الذكاء الاصطناعي في مجال الحفاظ على النظام العام أو ما يصطلح عليه بالضبط الإداري الالكتروني وتم التركيز على أنظمة الذكاء الاصطناعي في هذا المجال كأنظمة اليقظة الالكترونية والاستشراف ثم تطرقت إلى تطبيقات الذكاء الاصطناعي في مجال توفير الحاجيات الجماعية للمواطنين المرفق العام والخدمة العمومية الالكترونية وتم تركيز الدراسة في الخدمة العمومية على التعليم والصحة والقضاء كما تم التطرق إلى تطبيقات الذكاء الاصطناعي في الوسائل القانونية للنشاط الإداري وتم دراسة في هذا الجانب القرار الإداري الخوارزمي والمسؤولية الإدارية للذكاء الاصطناعي ثم تناولت العقد الإداري الذكي وتم التركيز على الصفقات العمومية والوكيل الذكي في إبرام عقد الصفقة كما تم التوصل إلى نتيجة هامة وهي انه عند تطبيق ممكنات الذكاء الاصطناعي هناك فجوة كبيرة بين التشريع وهذا التطبيق . this study aims to examine the impact of the application of artificial intelligence capabilities in the activity of public administration and the extent of its employment by entering the public administration into the era of electronic administration after the transition from the traditional pattern to the smart one by allowing the creation of applications for artificial intelligence in many activities with the study، identification and control of laws and legislations without going into the technical aspect of it has been studied، and the legal system and legal responsibility resulting from this application have been studied and the study dealt with the applications of artificial intelligence in the field of maintaining public order or what is termed exactly the electronic administrative، and the focus was on artificial intelligence systems in this field such as electronic vigilance and foresight systems and then touched on the applications of intelligence in the field of providing the collective needs of citizens، the public utility and the electronic public service. the study in the public service focused on education، health and the judiciary. the applications of artificial intelligence in the legal means of administrative activity were also discussed. in this aspect، the algorithmic administrative decision and administrative responsibility for artificial intelligence were studied، and then it dealt with the administrative contract. the smart focus was on public deals and the smart agent in concluding the deal contract، and an important conclusion was reached، which is that when applying the capabilities of artificial intelligence، there is a large gap between the legislation and this application.
