الأحكام الفقهية المتعلقة بالتحاليل الطبية

Abstract

من المستجدات التي ينبغي دراستها فقهيا التحاليل الطبية وأهم الأحكام المتعلقة بها وهي عديدة، وفي هذا البحث إشارة إلى بعض الأحكام في باب العبادات كطهارة وصلاة وصيام وغير العبادات كالزواج واثبات النسب. ما يراد تحليله من حيث طهارته ونجاسته كالدم والقيم والمني وسحب الدم هل ينقض الوضوء أم لا؟ وحكم أدوات المخبر إذا كانت مستوردة من البلاد الغربية. صلاة المحلل بثياب عمله وحكم فوات وقت الصلاة من أجل الانشغال بالتحليل وحكم سحب الدم لصائم هل يفطر أم لا؟ وحكم حلق شعر المحرم إذا تطلب الأمر ذلك. زكاة الأجهزة المخبرية واشترط التحاليل قبل الزواج التحاليل في اثبات النسب ومع ذكر أقوال العلماء المعاصرين وبيان الراجح في هذه المسائل. Among the developments that should be studied jurisprudentially are medical analyzes and the most important rulings related to them, which are numerous. In this research, there is a reference to some rulings in the chapter on acts of worship, such as purity, prayer, fasting, and other acts of worship such as marriage and proof of lineage. What is to be analyzed in terms of its purity and impurity, such as blood, values, semen, and drawing of blood, does it invalidate ablution or not? And the rule of detective tools if they are imported from Western countries. The prayer of the analyzer in his work clothes and the ruling on missing the time for prayer due to being occupied with the analysis, and the ruling on drawing blood for a fasting person, does he break his fast or not? And the ruling on shaving the hair of the Muharram if necessary. Zakat on laboratory equipment, and pre-marriage tests are required to prove parentage, with mentioning the sayings of contemporary scholars and an explanation of the most correct in these issues.
