الإلتزام بالإعلام في عقد البيع بناء على التصاميم

Abstract

إن إتساع مجالات التعامل في العقارات، دفع المشرع الجزائري إلى التدخل لتنظيم نوع من العقود المستحدثةومن بينها عقد البيع بناء على التصاميموهذابموجب القانون 11-04 الذي يحدد القواعد التي تنظم نشاط الترقية العقارية، جاء هذا القانون لسد التغرات التي إنطوت عليها النصوص القديمة والتي إستغل وجودها المرقيين العقاريين، حيث نص هذا القانون على الجزاءات المطبقة في حال إخلالهم بإلتزامهم بالإعلام الذي يفرضعلى المرقي العقاري تبصير المشتري في المرحلة السابقة للتعاقد بكافة المعلومات المتعلقة بالعقد المراد إبرامه( أصل الملكية، رقم السند العقاري............) وذلك بهدف حماية المشتري والحرص على عدم وقوعه ضحية إستغلال أو غلط بسبب المعلومات المتعلقة بالمشروع العقاري والتي تبقى حكرا على المرقي العقاري بإعتباره مهنيا مختصا في المجال.

The expansion of the areas of dealing in real estate, prompted theAlgerian legislator to intervene to organize a type of new contracts, among them is the contract of sale based on the designs, and that’s in the law 11-04 the specified rules governing the activity of real estate promotion, this law came to fill the fill the changes involved in the ancient texts, which were exploited and the existence of real estate developers, as this law provided for the applicable sanctions in case of breach of their obligation, and among these obligations is the obligation to inform, which obliges the real estate developer to inform the buyer at thePre-contract stage of all information related to the contract to be concluded (original of ownerships, real estate deed number)this is in order to protect the buyer and ensure that he is not exploited or made a mistake because information related to the real estate project, which remains the preserve of the real estate developer as a competent professional in this filed.
