الرقابة على قرارات التعيين والترقية في الوظيفة العمومية

Abstract

تتناول هذه الدراسة موضوع الرقابة على قرارات التعيين والترقية في الوظيفة العمومية الجزائرية، لما لهذه القرارات من أثر مباشر على تسيير الموارد البشرية وضمان العدالة الإدارية. وتهدف إلى تحليل الإطار القانوني المنظّم لها، وتقييم فعالية الجهات الرقابية الإدارية والمالية والقضائية في فرض احترام مبدأ الشرعية والشفافية. اعتمدت الدراسة المنهج الوصفي التحليلي، وتوصلت إلى وجود فجوة بين النصوص القانونية والتطبيق العملي، تعود أساسًا إلى ضعف التنسيق وتباين الممارسات. وقد خلصت إلى توصيات تتعلق بتحديث النصوص، وتحسين آليات الرقابة، وتوسيع استعمال الرقمنة لترسيخ مبدأ الاستحقاق في الوظيفة العمومية.

This study examines the oversight mechanisms applied to appointment and promotion decisions within the Algerian civil service. These decisions are central to public human resource management and raise important legal and administrative concerns. The research analyzes the legal framework governing such decisions and evaluates the effectiveness of the administrative, financial, and judicial bodies responsible for ensuring their legality and fairness. Using a descriptive and analytical method, the study reveals a gap between legal provisions and practical implementation, often due to weak coordination, procedural ambiguity, and limited employee access to legal remedies. It concludes with recommendations to enhance regulatory clarity, strengthen institutional coordination, and digitize oversight processes to promote transparency and meritocracy in public administration.
